The Regulation of the Protection of Personal Information

1 Objectives

This Regulation is to provide the necessary issues regarding how to control and process the private information of members and others by International Society for In Vitro Fertilization (ISIVF)(this “Association” in this Regulation)

2 Definitions

The matters which are not specifically provided in this Regulation shall follow those provided in the Act of Protection of personal Information in Japan (the Act #57 in 2003) (the “Act”).

3 The Purpose of the Use

Section 1              This Association may use the private information for the following purposes,

  • (1) To operate this Association appropriately and effectively.
  • (2) To operate the businesses to satisfy the objectives of this Association, and
  • (3) To provide any information relating to the various services of this Association.

Section 2              This Association shall not change the purpose of the use of the private information other than such change can be thought as reasonably related to the prior purpose provided in this Regulation.

4 The Limitation of the Use other than the Use of the Purposes

Section 1              This Association shall not process any private information for specified purpose provided in Article 3 without prior consent of holders of such private information.

Section 2              In case that this Association obtains any private information in any event of the assignment and transfer from other entity which is provided as business operators (as the definition by the Act”), this Association shall not process any such private information without prior consent of the holder of such private information.

Section 3              The above two sections shall not be applied to the following events,

  • (1) Following any laws and regulations, or

    (2) Being difficult to obtain any consent of the holder of the private information when to use such private information is necessary to protect any life, body or asset of any person.

5 Limitation of Obtainment

Section 1              This Association shall express the purpose of use of any private information to obtain such information and obtain them legitimately and appropriately.

Section 2              This Association shall not obtain any sensitive information without any prior consent of the holder of such information other than any following events,

(1)         Following any laws and regulations, or

(2)         Being difficult to obtain any consent of the holder of the private information when to use such private information is necessary to protect any life, body or asset of any person.

6 Notice or others of the Purpose of Use at the time of Obtainment

Section 1              This Association shall notice to a holder or make it to public the purpose of use of any such Private Information when obtaining other than such purposes has been already publicized.

Section 2              This Association shall notice to a holder or make it public the change of purpose of use of the Private Information.

Section 3              The above two sections shall not be applied to the following events,

  • (1) Any notice or publication of the purpose of the use of any private information may cause any damages to any life, body or asset of any other person,
  • (2) Any notice or publication of the purpose of the use of any private information may cause any damages to legitimate rights and interest of this Association; or
  • (3) Any notice or publication of the purpose of the use of any private information may cause any problems to proceed any businesses of any central governmental offices or local public organization offices when this Association is legally obligated to cooperate to such businesses, or

   (4) The purpose is clear from the circumstances of the obtainment of such personal information.

7 The Limitation of Transfer to any Third Party

This Association shall not transfer any personal data without any prior consent of a holder of such data other than the following events;

(1)         Following any laws and regulations, or

(2)         Being difficult to obtain any consent of the holder of the personal data when to use such personal data is necessary to protect any life, body or asset of any person.

8 Appropriate Control to Process of Personal Data

Section 1              This Association shall control any personal data appropriately and keep such data as accurate and newest contents as possible to the extent to accomplish the purpose of the use of them.

Section 2              This Association shall take necessary and appropriate measures to control securely of personal data to protect from divulging, destruction, defection or any such event.

Section 3              This Association shall discard any personal data immediately when such information becomes not necessary regarding its purpose of use and not needed to record such information.

Section 4             This Association shall proceed necessary and appropriate supervising of any third party processor which this Association may engage with to process all or a part of the personal information.

9 The Disclosure of Personal Data

  • This Association shall disclose any personal data to their holder after checking the person who requests such disclosure is the holder of them in case any person requests of disclosure orally or in written.

10 Revision, Addition, Deletion, Suspension, or Elimination of the personal data

This Association shall notice the result of review to a holder who requests of the revision, addition, or deletion, suspension of use or elimination of all or a part of his/her personal data, after reviewing such request to the extent such review is necessary for the purpose of the use of this Association.

11 Administrator of Protection of Personal Information

Section 1              This Association shall designate an administrator of protection of personal information and make him/her take necessary measures for the appropriate control and process of them.

Section 2              The administrator as provided in the above section shall be the President.

12 Respondence to any Complaint

Section 1              This Association shall make effort to process to any complaint appropriately and promptly.

Section 2              This Association shall take necessary measures to accomplish the purpose of the above section.

13 Revision

This Regulation may be revised by the resolution of the board.

Supplementary provisions

  1.           This Articles of the Association shall be implemented from 1st April 2023.
